Welcome to NoDruma. Please read these Terms and Conditions carefully before using our service.
1. Acceptance of Terms
By accessing or using NoDruma (“Service”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service.
2. Service Description
NoDruma is a web-based application that uses artificial intelligence to remove drum tracks from audio recordings. The Service allows drummers to practice playing along with music by:
- Searching for or providing links to publicly available audio content
- Processing audio through AI-powered source separation technology
- Streaming the processed drumless audio for personal practice purposes
The Service is intended solely for personal, non-commercial, educational practice purposes.
3. Eligibility
You must be at least 16 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. User Responsibilities and Acceptable Use
4.1 Content and Usage
The Service retrieves publicly available audio content from third-party platforms on your behalf. By selecting a song for processing, you acknowledge and agree that:
- You will use the processed drumless audio only for personal practice and educational purposes
- You are responsible for ensuring your use of the Service complies with applicable laws in your jurisdiction
- Any downloaded or streamed processed audio is strictly for your personal, offline practice use and must not be shared, redistributed, or made publicly available
4.2 Prohibited Uses
You agree NOT to:
- Use the Service for any commercial purposes
- Redistribute, share, sell, or publicly perform any processed audio tracks
- Use the Service to infringe upon any copyright, trademark, or other intellectual property rights
- Use automated tools, bots, or scripts to access the Service excessively
- Attempt to reverse engineer, decompile, or hack the Service
- Use the Service for any illegal purposes
4.3 Copyright and Fair Use
NoDruma processes copyrighted audio recordings to create drumless versions for personal practice. We believe this use may be supported by fair use principles under U.S. copyright law (17 U.S.C. § 107) and analogous exceptions under EU and Italian copyright law, based on the following considerations:
- Transformative Purpose: The drumless audio serves a different purpose than the original — it is a practice tool, not a commercial entertainment product. Courts have recognized that transformative uses adding “new expression, meaning, or message” receive stronger fair use protection (Campbell v. Acuff-Rose Music, 510 U.S. 569, 1994).
- Educational Use: The Service is designed exclusively for drummers' personal practice and skill development, aligning with educational exceptions recognized in copyright law.
- No Market Substitution: Drumless practice tracks do not substitute for original recordings in the commercial marketplace, as they serve fundamentally different functions.
- Private Use: Processing is performed on-demand for individual users' personal, non-commercial purposes, comparable to recognized private copying exceptions (EU Directive 2001/29/EC Art. 5; Italian Law 633/1941 Art. 71-sexies).
Important: Fair use and copyright exceptions are subject to legal interpretation and vary by jurisdiction. We make no guarantee that all uses of this Service will qualify as fair use. You are solely responsible for ensuring your use complies with copyright laws in your jurisdiction. Original copyrights in all source recordings remain with their respective owners.
5. Intellectual Property
5.1 Service Ownership
NoDruma, including all software, algorithms, design elements, and branding, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes only.
5.2 Processed Content
We do NOT claim any ownership rights to the processed audio you create using the Service. However, original copyrights in source material remain with their respective owners. Processing audio through our Service does not transfer any copyright ownership to you.
5.3 Storage
Processed audio files are stored temporarily on our servers to enable playback and download. These files are automatically deleted within 24 hours. We do not guarantee the availability of any processed audio beyond this period.
6. DMCA and Copyright Takedown
We respect intellectual property rights. If you believe that content processed through our Service infringes your copyright, please contact us at legal@nodruma.com with:
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material
- Your contact information
- A statement of good faith belief and accuracy under penalty of perjury
- Your physical or electronic signature
7. Disclaimers and Limitation of Liability
7.1 Service “As Is”
The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or uninterrupted operation.
7.2 Processing Quality
We do not guarantee that drum removal will be perfect for all songs, that processed audio will be free of artifacts, or that the Service will work equally well for all musical genres.
7.3 Third-Party Services
The Service relies on third-party platforms and services. We are not responsible for their availability, functionality, or changes to their terms of service.
7.4 Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, data, use, or goodwill, service interruptions, or any copyright infringement claims arising from your use of the Service. Our total liability shall not exceed €50.
8. Service Availability and Modifications
We do not guarantee that the Service will be available at all times. We may suspend, modify, or terminate the Service at any time without notice. We may impose usage limits or implement a paid subscription model.
9. Privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
11. Termination
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for violation of these Terms, excessive or abusive use, suspected copyright infringement, or legal requirements.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Italy and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.
13. Severability
If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.
